Statutory Mandate & Uniform Rule 41A Overview
Uniform High Court Rule 41A came into operation in March 2020, establishing that in every new action or application instituted in the High Court of South Africa, the plaintiff or applicant must serve and file a formal Form 27 Notice of Agreement or Opposition to Mediation alongside the initiating summons or notice of motion.
A defendant or respondent must similarly deliver a Form 27 Notice indicating whether they agree to or oppose referral of the dispute to mediation. Failure to consider mediation bona fide or unreasonable opposition exposes litigants and their legal practitioners to punitive adverse cost orders by the trial court.
Key Precedents & Adverse Cost Jurisprudence
- Brownlee v Brownlee (2010): Foundational precedent establishing that legal practitioners have an affirmative duty to advise clients on mediation; failure to mediate resulted in cost forfeiture.
- MB v NB (2010 3 SA 220 GSJ): Court capped attorney fees on attorney-and-client scale due to failure to mediate family disputes under Rule 41A.
- Koetsier v S (2021): Confirmed that mediation remains privileged, confidential, and without prejudice under Rule 41A(4).
